Hi Angie!

I agree w/Jennifer - good question! We're actually slowly incorporating using AI in our firm. It's a bit tricky, as you must be very careful that you don't allow PII or confidential information to be revealed. And we've had to add language to our client letters, etc., that informs them that at times we'll be using AI but that we're taking all reasonable measures to protect their confidential information to minimize the risk of inadvertent disclosures. We reassure them that we thoroughly vet the security and privacy policies of any AI tools utilized during our representation and that we will only bill them for the actual time spent using AI and reviewing the output. In any event, AI has been a super time-saver so far for us, at least in these early days.

Interesting question, Angie! I am not a criminal lawyer, so I will be interested to see if someone with that experience answers this question. That said, there are so many opportunities for how we could integrate AI in our justice system, everything from basic scheduling, to jury selection, to factual analysis, opinion writing, before we even think about introducing it into decision-making. But with the current state of AI, we should be very nervous (justifiably so) about the impact of the inherent bias in existing LLMs. There is also a lot to consider about our rights and the rule of law in our justice system. Barring significant changes to a defendant's due process rights, it would be unthinkable to hand decision-making over to an AI model rather than judge or jury.

What positives and negatives do you think we might experience by going down this path?
